Mashantucket Pequot Tribal Nation Announces Resignation of Foxwoods Resort Casino President John O'Brien (108.06K)
MASHANTUCKET, Conn., Jan. 11 /PRNewswire/ -- The Mashantucket Pequot Tribal Nation today announced that John O'Brien, President of Foxwoods Resort Casino, has tendered his resignation, effective January 18, to pursue other interests. Current Foxwoods Senior Vice President of Operations, Barry J. Cregan, 54, will serve as interim President of Foxwoods effective January 18. Mr. Cregan is currently responsible for overseeing the day-to-day operations of Foxwoods as well as managing the growth and expansion projects underway at Foxwoods. He is also heavily involved with the pre-opening of the MGM Grand at Foxwoods scheduled for May 2008, working closely with Gillian Murphy, General Manager of the MGM Grand at Foxwoods.

Starbucks Emails Describe Efforts to Stop Unionization  (97.75K)
A series of emails by Starbucks Corp. managers sheds light on the company's efforts to thwart union organizing among its baristas. The emails, which are part of a labor-dispute proceeding in New York and were reviewed by The Wall Street Journal, open a rare window onto the company's labor relations practices. Labor experts not involved with the case said the activity is not illegal. But the emails could prove embarrassing because they show managers using various methods to identify pro-union employees. The Industrial Workers of the World, or IWW, has been trying to organize workers at Starbucks since 2004 and has been able to organize only several dozen at a handful of stores in New York and a few other cities.

Hearing Scheduled over Foxwoods Dealers' Union Vote (59.46K)
HARTFORD, Conn. - The struggle against the imposition of federal law on sovereign tribal lands will continue at a National Labor Relations Board hearing into the Mashantucket Pequot Tribal Nation's complaints over a union vote at Foxwoods Resort Casino. The hearing will take place Jan. 15 at the board's office in Hartford.

Tennessee Commercial Warehouse Layoffs Eliminate Union Supporters (102.85K)
KINGSPORT, Tenn., Jan. 7 /PRNewswire-USNewswire/ -- In a vicious attack on human and worker rights, 33 employees were permanently laid off by Tennessee Commercial Warehouse (TCW) in retaliation to the workers exercising their legal right to join a union. The overwhelming majority of the workers had signed authorization cards with Teamsters Local 5in Blountville, Tennessee to retain the union as their bargaining representative.

Hospitals Accused of Labor Violations (86.58K)
The Citrus Valley hospital group faces a hearing as a result of charges by unionizing employees that the hospital engaged in unfair labor practices. Service Employees International Union United Healthcare Workers-West and its supporters accused the hospitals of violations such as interrogating union supporters and selectively using anti-loitering rules only against union supporters. Citrus Valley Medical Center denied all the accusations of unfair labor practices, calling them typical union tactics.

In Wake of Recent Manpower Loss, FreshDirect Workers Vote ‘No Union’ (66.55K)
The low-wage warehouse workers at FreshDirect, the online grocery delivery service, voted overwhelmingly against union representation this weekend, according to the company and the two unions vying to represent the workers. The vote was held about two weeks after the company suspended and lost scores of employees who could not provide accurate records of their residency status. Most of them were Hispanic and many of them were among FreshDirect’s most experienced workers. The National Labor Relations Board conducted the vote, by secret ballot, on Saturday and Sunday.

NLRB Finds No Statutory Right to Use Employer's E-mail System for "Section 7 Communications" (107.10K)
In The Guard Publishing Company, d/b/a The Register-Guard, 351 NLRB No. 70 (December 16, 2007), the National Labor Relations Board, in a 3-2 decision, held that an employer did not violate Section 8(a)(1) by maintaining a policy that prohibited employees from using the employer’s e-mail system for any “non-job-related solicitations.” The Board majority also announced and applied a new standard for determining whether an employer has violated Section 8(a)(1) by discriminatorily enforcing its policies. In deciding the case, the Board considered the exceptions and briefs of the parties, amicus submissions from various organizations, and presentations by the parties and some amici at an oral argument on March 27, 2007.

Labor Board Sides With Dresser  (80.75K)
PAINTED POST -- Dresser-Rand Co. said Friday that the National Labor Relations Board has rejected most unfair labor practices charges filed by Local 313 IUE CWA. The company said in a news release that the federal agency determined the recent 16-week strike by 400 members of Local 313 was an "economic strike," not an "unfair labor practices" strike. That means, according to Dresser-Rand, that the company will not be required to pay back pay to strikers and will be allowed to keep permanent replacement workers hired during the strike. The company hired an estimated 90 replacement workers.

Legislators Pushing for Union in Casino (65.27K)
In the same week that contractors broke ground on Don Barden's North Shore casino site, Democratic state representatives from southwestern Pennsylvania's delegation are reiterating pleas for the Detroit businessman to sign a "neutrality" agreement with a labor group that represents thousands of American casino workers. The agreement would mean that Mr. Barden would remain agnostic on the issue of whether hospitality workers employed at his Majestic Star Casino should organize.
